固始县征地区片调整研究

Research on Adjustment of Land Expropriation Section in Gushi County

摘要： 为了探索征地区片划分的合理方式，为征地区片综合地价的实施提供操作方便，构建公平、公正的征地补偿制度提供保障，笔者以信阳市固始县为例进行实证研究，运用多因素综合评价法和综合判定法分别从所有乡镇行政区、重点乡镇行政区、城市建成区的角度出发设计方案，并进行对比分析。分析得出从城市建成区角度构建的方案三，征地区片的数量相对较少，区片之间相邻的条件相同的被征用土地以不同的标准补偿的情况得到了改善，更具公平与效率。可得出结论，征地区片在划定的过程中，除应具有科学性之外，还需从管理实践和保护农民权益2个角度出发，维护征地行为的公平合理。

Abstract: In order to find out a reasonable method to divide land expropriation section, provide easy operation for the implementation of land expropriation section comprehensive price and built a fair land safeguard mechanism for compensation system, the author took Gushi County of Xinyang as an example, using the method of multi-factor comprehensive evaluation and comprehensive judgement, designed and analyzed the projects from 3 aspects: all township administrative region, key township administrative region and urban builtup areas. The results showed that the third project was more equal and efficient, had relatively small number of land expropriation section, and overcomed the weak point of the same land with different price. The results also showed that in the process of region land partition, except scientificity, it was also necessary to have fair and reasonable management practices and protect famers’ rights and interests.
