集体建设用地使用权流转的制度创新

摘要: 充分利用现有集体建设用地,允许集体建设用地使用权流转,是节约集约利用土地的有效手段。在现实的背景下,理顺集体建设用地使用权流转的制度限制以及相关问题,创造性的提出从农村集体内部施行基层民主制度,对外施行法人制度,建立适应集体建设用地使用权流转的集体内外管理制度。在宅基地进行流转时提出禁止单一流转和集体讨论通过部分区域宅基地统一流转制度,并提出政府在宅基地获利中的分配。

Abstract: Making full use of collective construction land and permit it to be transferred is an effective way for economical and intensive land. Based on background, we found the limit of land transfer and try to create a new system of land requisition, management inside the collective famer organization and homestead management. Establish a democracy policy in the collective organization and build up a corporate person system to deal with the transfer to the third party. Forbid single transferring the homestead and put forward the government in profit distribution of land.
