Abstract: Since 1980s, with the promotion of the legal process in China, law plays a more and more important role in the dispute. But in the rural community, people have a “partiality” in the nonlegal way to solve the dispute. It is a kind of general phenomenon. I think this kind of partiality for peasants can not be ascribed to peasant's few legal consciousness, ignorant and backward behavior. It should be carried on overall analysis from two aspects of the behavioral host and system culture.
