Abstract:

In order to protect farmers’ rights on benefit-sharing and make legislative preparation for acceding to the International Treaty on the Plant Genetic Resources for Food and Agriculture, the sovereign and ownership of plant genetic resources and the difference between natural resources and plant genetic resources on farmers’ land are analyzed. The regulations on the ownership of the plant genetic resources on farmers’ land are studied, too. It is stated that the sovereign of plant genetic resources shall not substitute the ownership of them, plant genetic resources on farmers’ land shall be owned by farmers or their community, the farmers’ or their community’s rights to the plant genetic resources on their land shall be confirmed by the nation.
