Summary of the Feudal Agricultural Legal History as an Implication to the Modern Agricultural Legislative Construction

Abstract: Based on the analysis and research of the feudal agricultural legal history of our country, some shortcomings of the feudal laws are summarized and accordingly some measures for improving the modern legal system are suggested, that is, i) to establish a complete and independent agricultural legislative system and overcome the feudal agricultural legal shortcomings of being complexity and miscellaneous; ii) to properly treat the relationships between agriculture and commerce & industry and diminish the thought of preferring business to agriculture; iii) to protect farmers’ right while maintaining the interest of the state; iv) to reduce the random change of law with the succession of rulers so as to keep the stability of agricultural legislations; v) to strengthen the legislation of agricultural education and agricultural extension to enhance the quality and competence of agriculture-engaged people.
