城中村改造的法律困境与对策——以秦皇岛城中村改造为例

摘要: 内容摘要:城中村改造是城市发展的必经之路,由于缺乏系统的法律体系支撑,在改造过程中存在城中村土地的产权转换缺乏法律依据、补偿标准难以确定、集体经济组织改造后的形态选择等困难。在目前土地二元所有制难以突破的前提下,采用“土地信托”方式能够绕过产权障碍,充分利用城中村土地的区位优势,盘活土地资产,为城中村改造融资,运用专业化的运营模式促进城中村资产的保值和升值,有效解决城中村发展中的瓶颈。

Abstract: Legal Straits and Countermeasures of “VIC” Reconstruction ----Empirical study on the “VIC” Reconstruction in Qinhuangdao Abstract: “VIC” reconstruction is the only way of urban development, owing to the lack of systematic legal support, there are many problems existing in reconstructing process, such as legally groundless in the transformation of land property right, incapable of being defined in compensation standard, no participation right for villagers, restrained in the avenues of relief, selection of formation after transferring of collective economy organization. Through defining the established standards of “public interest”, establishing systematic land evaluation system and fixing the lowest compensation standard, protecting the participation right and litigious right for villagers, adopting “Land Trust” and some other ways to get out of the difficult position.
